Background

At the October 24, 2018, Executive Committee meeting, the State Auditor provided an exit conference in which they reviewed their audit report, management letters, and recommendations. One of the auditor’s recommendations pertained to Board of Health meeting minutes for executive sessions:

 

Open Public Meetings/Minutes: We noted two instances where the District did not document whether the presiding officer announced the time when executive sessions would be concluded. Therefore we could not determine whether the District fully complied with OPMA. We recommend the District ensure the minutes properly document executive session requirements in an Open Public Meeting in accordance with state law.

 

In reviewing Board meeting minutes and the audio recordings since the recommendation was given, two meeting minutes (Jan. 8, 2019, and Feb. 12, 2019) did not reflect the time the presiding officer stated for the record that the Board would reconvene into regular session. In order to fully comply with the OPMA and the State Auditor’s recommendation, those minutes have been corrected in the attached exhibits.

 

The following change (underlined) was made to the Jan. 8, 2019, minutes (Exhibit A):

 

Executive Session

Chair Fraley-Monillas announced that the Board will convene into executive session for the purpose of pending litigation (RCW 42.30.110(1)(i)). She stated that executive session is expected to last ten minutes; the Board will reconvene at 4:10 p.m. and is not expected to take action. The Board reconvened at 4:12 p.m.

 

The following change (underlined) was made to the Feb. 12, 2019, minutes (Exhibit B):

Executive Session

Vice Chair Hilt announced that the Board will convene into executive session for the purpose of pending litigation (RCW 42.30.110(1)(i)). He stated that executive session is expected to last five minutes and will reconvene at 3:31 p.m. The Board extended five minutes. The Board reconvened at 3:36 p.m.

Recommended Motion

MOVE TO approve corrected minutes for the Jan. 8 and Feb. 12, 2019, Board meetings to meet OPMA requirements and the State Auditor’s recommendation.
